Terms of Use

These Terms of Use govern access to and use of the Pacoo app and related services.

1. Definitions

"Pacoo", "we", "us", "our" refer to the operator identified above (the "Operator").

"Service" means the Pacoo mobile application, the pacoo.co website, and any related services, features, content, and communications we provide.

"User", "you" refers to any person who accesses or uses the Service.

"Content" includes any information, text, images, photos, GIFs, messages, reactions, profiles, and other materials available on the Service.

"User Content" means Content you upload, submit, post, send, share, or otherwise make available through the Service (including in Table, Discover, and Duo).

"Table" means the daily shared card experience where Users respond to the same daily cards.

"Discover" means the feed that may display daily card responses across the Service for that day.

"Duo" means private one-to-one gameplay and messaging between Users.

"18+ Packs" means card packs labeled for adults (18+) and gated by an age warning.

2. Acceptance of these Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

You also agree to our additional policies and notices that may apply to specific features (e.g., rules for reporting, community rules, or purchase terms). If there is a conflict, these Terms prevail unless stated otherwise.

3. Eligibility and Age Requirements

Minimum age. You must be at least 13 years old to use the Service.

If you are under the age of majority where you live, you represent that you have permission from a parent or legal guardian to use the Service, and that your parent or guardian accepts these Terms on your behalf.

18+ Packs. You must be at least 18 years old to access or use any 18+ Packs. By attempting to access an 18+ Pack, you represent and warrant that you are 18 or older.

If we suspect or become aware that you are under 13, or that you accessed an 18+ Pack while under 18, we may suspend or terminate your account, and remove associated Content, without notice. Accounts associated with misuse of 18+ Packs may be permanently banned.

4. Account Registration and Security

You may need an account to use the Service. You may register via email/password or third-party sign-in (Apple or Google).

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate information and keep it up to date. You must not impersonate another person or misrepresent your identity.

We may refuse registration, suspend, or terminate accounts that we reasonably believe are fraudulent, abusive, or violate these Terms.

5. The Service and Key Features

Pacoo is a social game designed to help Users get to know each other better through humorous card prompts and responses.

Table: Each day, the same set of daily cards is distributed to Users. Users can respond and view responses from their friend circle (subject to privacy settings and availability).

Discover: The Service may display daily card responses across the Service for that day. Discover does not recommend people; it displays responses to that day's cards.

Duo: Users can play privately one-to-one by exchanging cards and messages within a private conversation.

6. User Content and Visibility

You are solely responsible for your User Content. You represent and warrant that you have all rights needed to submit your User Content and that it does not violate any law or the rights of any person.

Table and Discover visibility. Your daily card responses may be visible to your friend circle, and may also appear in Discover for that day, depending on the feature and your settings.

Duo visibility. Messages and gameplay in Duo are intended to be private between you and the other User. However, we may access or review Duo content as described in these Terms (e.g., to respond to incidents, enforce Terms, comply with law, or protect the Service).

Profile visibility. Your username, display name, and profile photo are public by default. You may be able to set your profile to private, which can restrict visibility of your historical played cards over time, but does not necessarily make your identity fields private.

Screenshots and sharing. Users may capture screenshots or otherwise share what they see. We are not responsible for how Users share Content outside the Service.

7. License You Grant to Pacoo

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for technical formatting and display), communicate, publish, display, distribute, and otherwise make your User Content available as necessary to operate, improve, and promote the Service.

Marketing and promotion. This license includes the right to use your User Content (including excerpts, screenshots, or recordings of in-app displays) for marketing, promotion, and advertising of the Service, in any media, worldwide, provided that we will not intentionally disclose private Duo messages as marketing without your consent.

You retain any ownership rights you have in your User Content.

8. Content Moderation, Reporting, and Enforcement

We may (but are not obligated to) monitor, review, moderate, or remove Content, at any time and for any reason, including without notice.

Public content moderation. We use automated and/or human moderation mechanisms to detect and block nudity and other prohibited content from being displayed publicly (including in Discover). Repeated attempts to upload prohibited content may lead to automated enforcement actions (warnings, suspensions, or bans).

Notice and action. You may report Content or Users through in-app tools. We will review reports and may take action at our discretion.

Sanctions. If you violate these Terms, we may issue warnings, remove Content, limit features, suspend your account, or permanently ban you.

Appeals. You may contest a moderation or enforcement decision by contacting support@pacoo.co with relevant details.

9. Prohibited Conduct

You agree not to, and not to assist others to:

• Illegal content or activities, including any content involving child sexual abuse material (CSAM) or sexual content involving minors (zero tolerance).
• Harassment, bullying, threats, hate speech, or incitement of violence.
• Non-consensual intimate imagery, "revenge porn", or sexually explicit content shared without consent.
• Nudity or sexual content intended for public display where prohibited by these Terms or by law.
• Impersonation, deception, fraud, or phishing.
• Doxxing or sharing personal data of others without authorization.
• Infringement of intellectual property rights or other rights of any third party.
• Spam, automated activity, bots, scraping, or attempts to access the Service by automated means without our written permission.
• Interference with the Service, hacking, malware, reverse engineering, or attempts to bypass security or access restrictions.
• Using the Service for commercial solicitation, advertisements, or selling without our permission.

10. Intellectual Property

The Service, including all card prompts, packs, themes, branding, logos, designs, software, and all non-User Content are owned by or licensed to us and are protected by intellectual property laws.

You may not copy, reproduce, distribute, create derivative works, or exploit any part of the Service (including the card database and packs) without our prior written permission, except as expressly permitted by law.

11. Third-Party Services (Apple, Google, GIPHY, etc.)

The Service may integrate or rely on third-party services, including Apple Sign In, Google Sign-In, Apple App Store, Google Play, and GIPHY for GIF access.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services and do not control their content, availability, or functionality.

12. Privacy and Data Processing

We process personal data to operate the Service, including account details, profile information, gameplay responses, messages, and analytics. We use service providers such as Supabase, OneSignal, RevenueCat, and PostHog.

Our data hosting may be located in the United States.

Details on data processing, retention, and your rights will be described in our Privacy Policy (to be published at pacoo.co).

13. Suspension, Termination, and Account Deletion

You may delete your account at any time through the in-app account deletion feature. Deletion is intended to remove your account and associated data without undue delay.

We may suspend or terminate your access to the Service at any time if we believe you violated these Terms, pose a risk to other Users, or if required by law.

Upon termination, your right to access the Service ends. We may retain certain information where required by law or for legitimate purposes (e.g., security, fraud prevention, legal compliance).

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of harmful components.

We are not responsible for the conduct of Users or for User Content, whether public or private. You interact with other Users at your own risk.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) EUR 50.

Some jurisdictions do not allow certain limitations of liability. In such cases, these limitations apply to the fullest extent permitted by applicable law.

16. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another.

17. Changes to the Service and these Terms

We may modify the Service or discontinue features at any time.

We may update these Terms from time to time. If changes are material, we will provide notice through the Service or by other reasonable means. Continued use after the effective date means you accept the updated Terms.

18. Governing Law and Disputes

These Terms are governed by the laws of: the laws of the Province of Quebec (Canada) and the applicable federal laws of Canada, without regard to conflict of laws rules.

If you are a consumer, you may also benefit from mandatory protections under the laws of your country of residence.

Before filing a formal claim, you agree to contact us at support@pacoo.co so we can try to resolve the issue informally.

20. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

These Terms constitute the entire agreement between you and us regarding the Service, and supersede any prior agreements.
